JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 11-05-2017 From the materials on record, it transpires that the petitioner is aggrieved by an order, dated 24.03.2017 passed by learned Additional Sessions Judge I, Cum-Special Judge, Katihar in Azamnagar P. S. Case No. 44 of 2017, registered for the offence punishable under Sections 341, 323, 504, 307, 379/34 of the Indian Penal Code and Section 3(i) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. The present application has been filed under Section 439(2) of the Code of Criminal Procedure, 1973 for cancellation of bail. In my view, this application is not maintainable. Patna High Court Cr.Misc. No.22411 of 2017 (2) dt.11-05-2017 learned Court below, there is remedy under Section 14A of the scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
This application is, accordingly, dismissed.
