2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) and 47 of Bihar Prohibition and Excise Act.

3 . It is alleged that 16.500 liters foreign liquor was recovered from seized car and petitioner is alleged to have fled away from spot.

4. It is submitted that the petitioner is innocent and has falsely been implicated in this case on the basis of suspicion . Petitioner is neither owner nor driver of the seized vehicle . No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery . Petitioner has got 2 criminal antecedents

Patna High Court CR. MISC. No.21322 of 2025(2) dt.23-04-2025 2/2 out of which 1 is of similar nature and he is on bail in both cases.

5 . Learned counsel for the State opposes the bail petition .

6. Considering the fact that petitioner is neither owner nor driver of seized vehicle and other circumstances of case , in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive special Excise Court No. - II Nawada in connection with Nawada Excise Police Station Case No. 911 of 2024 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
