JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 01-07-2017 Heard the counsel for the petitioner and Mr. Dayal, APP for the State.

Apprehending his arrest in Fulkaha P.S. Case No. 125 of 2016 registered under section 420 IPC, the petitioner has filed the present application for grant of anticipatory bail. The Circle Officer is the informant. On a secret information, the house of petitioner was searched and a huge quantity of fertilizer & chemicals including a weighing machine was/were recovered.

Contention of the petitioner is that he is a farmer. It is submitted that the seizure memo does not contain the signature of the petitioner or any other family member.

Mr. Dayal opposed the prayer and submitted that

Patna High Court Cr.Misc. No.21163 of 2017 (2) dt.01-07-2017 2/2 petitioner was involved in black-marketing of the chemicals. Considering the allegation and other materials reflected from the records, I am not persuaded to grant anticipatory bail to the petitioner. Prayer is accordingly rejected. The petitioner shall surrender and pray for regular bail which shall be considered by the court below on its own merit in accordance with law.
