02. 21.10.2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-B) A, 25(1-AA), 26(i)(ii) and 35 of the Arms Act.

It is contended that five country-made pistols were recovered from the possession of the petitioner. It is further contended that the petitioner is in custody since 12.11.2015 and he is having clean antecedent.

Having regard to the facts and circumstances of the case, the petitioner, namely, Ripun Mistry is directed to be released on bail on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to

Patna High Court Cr.Misc. No.42886 of 2016 (2) dt.21-10-2016 the satisfaction of District Judge, Munger in connection with Kotwali P.S. Case No. 252 of 2015 (S.Tr. No. 47 of 2016) subject to the that one of the bailors must be a close relative or family member of the petitioner who shall file affidavit before the concerned court giving complete genealogy to show his/her relationship with him and the other bailor shall be the father of the petitioner.

However, at the time of accepting bail bond, the court below will verify and ensure itself regarding the criminal antecedent of the petitioner. If the petitioner is having clean antecedent then his bail bond would be accepted otherwise he would be taken in custody.
