Petitioner seeks bail in a case registered for the offence punishable under Sections 324, 307, 353, 224, 511 and 120B of the Indian Penal Code, Section 3/5 of Explosive substance Act, and Sections 25(1-b)A, 26, 27 and 35 of the Arms Act and Sections 7, 8 and 13 of Prevention of Corruption Act.
Allegation against the petitioner is of planting bomb in the prisoners vehicle along with FIR named accused which exploded and on account of which two police personnel became injured. It is further alleged that one live bomb and one sim was recovered from the possession of petitioner.
Patna High Court CR. MISC. No.26450 of 2020(6) dt.07-06-2021 2/2 Earlier also, petitioner had moved this Court for grant of regular bail which was rejected vide order dated 19.02.2019 passed in Cr. Misc. No.9451 of 2019.
It has been submitted on behalf of the petitioner that he is innocent and has falsely been implicated in this case. It has been submitted that petitioner is in custody since 15.05.2018.
Considering the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail once again. Hence, the prayer for bail of the petitioner is hereby rejected.
However, after framing of charges, petitioner would be at liberty to renew his prayer for bail.
