JUSTICE BIRENDRA KUMAR ORAL ORDER 30-01-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 272/273/34 of the Indian Penal Code and Section 47A of the Bihar Excise (Amendment) Act, 2016.
Allegation is that the country-made liquor was recovered from the possession of the petitioner. Petitioner is in custody since 30.09.2016. Para-3 of the application disclosed criminal antecedent of the petitioner, which includes different cases under the provisions of Excise Act.
Considering the facts and circumstances, let petitioner, above named, be released on bail after completion of
Patna High Court Cr.Misc. No.49548 of 2016 (3) dt.30-01-2017 2/2 seven months of custody on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sheikhpura/Successor Court, in connection with Korma P.S. Case No.39 of 2016 with condition that if the Court-below would come to the notice that the petitioner has again committed same type of offence, it would be a ground of cancellation of bail of this petitioner.
