JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-06-2017 Heard learned counsel for the petitioner and learned APP representing the State.

Petitioner apprehends his arrest in connection with Jhajha P.S. Case No. 203 of 2016 registered for the offences punishable under Sections 341, 323, 307, 504/34 of the Indian Penal Code.

Allegedly, the petitioner and other co-accused came to break the wall being armed with lathi-danda and when the informant obstructed, they assaulted the informant causing injury to him.

Submission is of false implication and that the allegations are omnibus and general in nature, there is no specific allegation against the petitioner, the injury caused to the informant is simple in nature caused by hard and blunt substance and as such the petitioner deserves sympathetic consideration.

Patna High Court Cr.Misc. No.22143 of 2017 (2) dt.19-06-2017 Learned APP after going through annexure-2 which is injury report of the informant fairly submits that simple injury has been caused by hard blunt object.

In the facts and circumstances stated above, the petitioner above named, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Jamui in connection with Jhajha P.S. Case No. 203 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) avin/- U T
