This application for grant of anticipatory bail arises out of Manjhagarh P.S. Case No. 192 of 2018, disclosing offence under Sections 147, 148, 149, 341, 323, 324, 307, 302 and 504 of the Indian Penal Code.
There are 14 persons named in the First Information Report. Learned counsel appearing on behalf of the petitioner submits that the petitioner is an old man of 70 years. Though there is allegation of assault against other accused persons, except for the allegation that the petitioner was also a member of the mob, there is no allegation against him. Considering the above submission, this application is allowed. The petitioner, above named, in the event of his arrest
Patna High Court Cr.Misc. No.74230 of 2018(2) dt.21-12-2018 2/2 or surrender before the Court within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj, in connection with Manjhagarh P.S. Case No. 192 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
