JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but submission on behalf of the petitioner is that petitioner was taken into custody in connection with Dhanha P.S.Case No. 05 of 2016 only on the basis of suspicion and police got recorded so called confessional statement of petitioner and, thereafter, petitioner was remanded in this case on 29.07.2016 and since then he is languishing in jail custody.

Admittedly, petitioner has not been put on T.I.P. as yet nor anything has been recovered from his conscious possession and except confessional statement, there appears to be nothing against him.

Accordingly, let the petitioner, above named, be

Patna High Court Cr.Misc. No.46154 of 2016 (2) dt.21-10-2016 2/2 released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bagaha in connection with Chautarwa P.S.Case No. 289 of 2015.
