The petitioners apprehend their arrest in Complaint Case No. 508 of 2012, registered for the offences punishable under Sections 341, 323, 379 and 504 of the Indian Penal Code and Sections 3(i)(x) of the Code of Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act. Mangru Ram the complainant alleged that he had come to the house of Upendra Choudhary for giving some gift. He took a cup of tea at a tea stall where the petitioners abused him and spit on his face.

Learned counsel for the petitioners submits that Upendra Choudhary is their co-sharers. The complainant is

Patna High Court Cr.Misc. No.420 of 2015 (2) dt.08-01-2015 resident of a village situated 20 kms. away from the house of the petitioners. Upendra Choudhary is also a witness of the case and the complainant has not stated about the presence of Upendra Choudhary. Ghanshyam Mishra relative of Upendra Choudhary is also made witness of this case who is resident of a village situated in Kamtaul.

It appears that on account of some family disputes, the present case has been lodged.

Considering the facts aforesaid, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Abhishek Kumar, the learned Judicial Magistrate 1st Class, Darbhanga in connection with Complaint Case No. 508 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
