The petitioner is in custody since 08.02.2019 in connection with Daudnagar P.S. Case No. 392 of 2018 for the offence registered under Sections 302/201 of the Indian Penal Code.

Learned counsel for the petitioner submits that earlier the name of the petitioner has not transpired in the first information report but subsequently, during the course of investigation, the husband of the petitioner was taken into custody and it is in the confession of the husband that the name of the petitioner has transpired. The allegation against this petitioner is that she was having an affair with the deceased and only because her husband had found them in a compromising

It is further submitted that save and except this allegation that she was entangled with the deceased person, the role of the petitioner in the alleged act of killing has not been alleged. Considering the aforesaid facts and circumstances of the case and the diary being indicative of only this factor and there being no further cogent material to indicate the active involvement of the present petitioner in the act of killing of the son of the informant, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Daudnagar P.S. Case No. 392 of 2018.
