====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 18-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Excise Case No. 504 of 2018 arising out of Dagaruwa P.S. Case No. 87 of 2018 instituted for the offence under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

Counsel for the petitioner submits that petitioner was not present on the spot.

It is alleged in the written report that foreign liquor has been recovered from Maruti Suzuki Celerio Car on which two persons found sitting were apprehended. They disclosed their name as Amit Kumar Rajak @ Sukho Rajak who was driving the vehicle and Ranjit Kumar who was found sitting on back seat of the vehicle.

Petitioner is in custody since 8.10.2018.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise, Purnea, in connection with Excise Case No. 504 of 2018 arising out of Dagaruwa P.S.
