JUSTICE SATYAVRAT VERMA ORAL ORDER 06-05-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State through virtual Court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioners seek bail in a case registered for the offences punishable under Sections 30(a), 32(ii)(iii), 36 and 41(i)(ii) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
Learned counsel for the petitioners submits that the petitioners are in custody since 23.03.2022, charge-sheet has been submitted and petitioner no. 1 is having one antecedent and petitioner no. 2 is a person with clean antecedent. Allegation is of recovery of 2212 litres of liquor from
Patna High Court CR. MISC. No.22458 of 2022(2) dt.06-05-2022 2/2 a truck.
Learned counsel for the petitioners submits that petitioners are the driver and the cleaner of the truck and, as such, were not knowing what the owner and the transporter kept in the truck.
Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioners.
Considering the fact that the petitioners are in custody since 23.03.2022, charge-sheet has been submitted and petitioner no. 2 is a person with clean antecedent and petitioners are the driver and the cleaner of the truck, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Special Case No. 8133 of 2021 arising out of Bikram P.S. Case No. 325 of 2021.
