17-09-2020 Heard learned counsel for the petitioner as well as learned A.P.P. for the State through video conferencing. The petitioner seeks bail in Forbesganj P.S. Case No. 79 of 2018, corresponding to S.T. No. 161 of 2018, registered for the offence punishable under Sections 302, 394, 411, 413 of the Indian Penal Code.

As per prosecution case, on 08-12-2018 at about 2:00 PM, the informant got information that some unknown miscreants have committed murder of night-guard of his underconstruction factory. It is submitted on behalf of petitioner that petitioner is not named in the FIR and his name has surfaced on the basis of confessional statement of co-accused Md. Ahmad. Save & except this, there is no material against petitioner to connect him with this case. It is further submitted that co-accused Md.

Patna High Court CR. MISC. No.24034 of 2020(2) dt.17-09-2020 2/2 Ahmad, Md. Nayeem Ansari and Md. Israfil have already been granted bail by this Court, vide order dated 04-10-2018 passed in Cr.Misc. No. 55125/2018, order dated 03-12-2018 passed in Cr.Misc. No. 69964/2018 and order dated 05-12-2018 passed in Cr.Misc. No. 72049/2018 respectively (Annexure - 2 to the petition). The petitioner is in custody since 09-03-2018. Let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Addl. Sessions Judge, Araria in connection with Forbesganj P.S. Case No. 79 of 2018, corresponding to S.T. No. 161 of 2018, on the following conditions:

"(1) Petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court and on his absence on two consecutive dates without sufficient reason, his bail-bond shall be cancelled by the Court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.".
