Learned trial court has reported that case is pending for appearance of other accused.

No doubt, petitioner is in jail custody since 26.4.2016 but there is allegation against the petitioner that he as well as other FIR named accused assaulted the deceased by means of lathi. Considering the aforesaid facts and circumstances as well as submissions of the parties, prayer for bail of the petitioner in connection with Ariyari P.S. case no. 11/2016 is, again, rejected. However, petitioner may renew his prayer for bail after framing of the charge.

Learned court below should proceed with trial of the petitioner even by separating his case from the case of other accused. Shahid (Hemant Kumar Srivastava,J) U T
