JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Tarabari P.S. Case No. 56 of 2014 registered for the offences punishable under Sections 304B/34 of the Indian Penal Code. Admittedly, petitioner is husband of the deceased who died due to burn injuries.

The contention on behalf of the petitioner is that deceased was caught in fire accidentally while she was cooking meal and the informant lodged this case under misconception but when she realized her fault, she filed affidavit before the court below disclosing real facts and taking note of the above stated facts, the parents in law of the deceased have already been admitted to anticipatory bail by a Bench of this Court vide order

Patna High Court Cr.Misc. No.611 of 2015 (2) dt.08-01-2015 dated 05.01.2015 passed in Cr. Misc. No. 51721 of 2014. Regard being had to the facts and circumstances of the case as well as submissions of the parties, I am not inclined to grant the privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with Tarabari P.S. Case No. 56 of 2014 pending in the court of Sri A.L. Mall, Judicial Magistrate 1st Class, Araria stands rejected. However, at the time of consideration of regular bail application of the petitioner, this order shall not cause any prejudice to the concerned court.
