Petitioner is apprehending arrest in connection with Muzaffarpur Excise Case No. 169 of 2018 for the offence under sections 30(a) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that during search illicit liquor was recovered from the hut. He submits that the hut is of uncle of the petitioner and not the petitioner. He further submits petitioner has no connection either with the hut or the liquor seized in the instant case. He also submits that neither petitioner consumed the liquor nor he is in the business of the liquor.

Considering the aforesaid, let the petitioner, named

Patna High Court Cr.Misc. No.75078 of 2018(2) dt.18-12-2018 2/2 above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur, in connection with Excise Case No. 169 of 2018, arising out of P.R. Case No. 24 dated 23.10.2018 subject to the condition as laid down under section 438(2) of the Cr.P.C.
