From perusal of order dated 08-03-2019 passed by learned Sessions Judge passed in B.P. No. 70 of 2019, it appears that bail application of the petitioner was dismissed by the court below for nonprosecution. No order has been passed on the merit of the case. Hence learned counsel for the petitioner seeks permission to withdraw the present application with liberty to file a fresh application before the learned court below.

Permission is accorded.

Accordingly, this application filed in connection with Chainpur P.S. Case No. 25 of 2019 is dismissed as withdrawn with the aforesaid liberty.
