Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner apprehends his arrest in a case registered under Section 365 of the Indian Penal Code and later on Section 302, 201, 34 IPC was also added.

Allegation against petitioner is of kidnapping the brother of the informant.

It has been submitted on behalf of petitioner that he is innocent and has been falsely implicated in this case only on the basis of suspicion. There is no eye witness of the occurrence. Petitioner has no criminal antecedent.

Petitioner is named in FIR and there is confession of co-accused Dilshad that petitioner alongwith one Raza kidnapped the brother of informant and committed his murder, as such, I am not inclined to grant bail to the petitioner. Accordingly this application is dismissed.
