JUSTICE SANDEEP KUMAR ORAL ORDER 13-07-2023 This application has been filed for quashing of the order dated 21.05.2019 passed by learned S.D.J.M., Saharsa, in Complaint Case No.05 of 2019, by which the learned Magistrate has found prima facie case under Section 498-A & 323 of the Indian Penal Code and under Section 3/4 of the Dowry Prohibition Act against the petitioner and directed for issuance of summon.

Learned counsel for the petitioner submits that the matter has been settled between the parties. However, learned counsel for the opposite party no.2 submits that he has no instructions on the same.

Considering the aforesaid facts, this application is disposed of with a liberty to the petitioner to file a joint compromise petition in the court below. The court below shall verify the genuineness of the compromise petition from the opposite party no.2. If the opposite party no.2 supports the joint compromise petition then the prosecution against the petitioner shall be dropped by the Court below. If the opposite party no.2 does not support the compromise petition then appropriate order shall be passed by the Court below.
