The petitioner seeks pre-arrest bail in connection with Majhauliya P. S. Case No. 148 of 2013 for the offences under Sections 366-A/376(2) G/120-B of the Indian Penal Code. Regard being had to the fact that the name of the petitioner transpired in course of investigation and it was found that the victim was gang raped, I am not inclined to grant prearrest bail to the petitioner. Accordingly, his prayer for grant of pre-arrest bail is rejected.

However, in case the petitioner surrenders and seeks bail, the same shall be considered on its own merit
