Petitioners are apprehending their arrest in Sahebganj P.S. Case no. 162 of 2016 for the offences registered under Sections 304B and 201/34 of the Indian Penal Code. It is alleged that petitioner demanded dowry in the form of Rs. 1 lac and a motorcycle from the sister of the informant and killed her due to non-fulfilment of the demand of dowry. It has been contended on behalf of the petitioners that they have got no criminal antecedent. They are elder brothers of the petitioner. They are separate in mess and property from the husband of the deceased. They have no concern with the deceased

Patna High Court Cr.Misc. No.22589 of 2017 (2) dt.01-06-2017 2/2 and her husband. It is further submitted that the victim girl had some affair with her Bahnoi, namely, Anirudh Mahto and she had eloped with him.

Considering the facts and circumstances of the present case, let petitioners, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM (West) Muzaffarpur, in Sahebganj P.S. Case no. 162 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
