The petitioner is apprehending his arrest in connection with Kalyanpur P.S. Case No. 28 of 2018 for the offence under Sections 120(B), 365, 34,363 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner would submit that the petitioner has no criminal antecedent. Referring to the prosecution case he submits that petitioner was made accused in this case only on suspicion. Learned counsel for the petitioner further submits that similarly circumstanced co-accused Rijhan Ray has been granted bail by Co-ordinate Bench of this Court in Crl. Misc. No. 49256 of 2018 vide order dated 11.10.2018.
Considering the aforesaid, let the petitioner above
Patna High Court Cr.Misc. No.74169 of 2018(2) dt.20-12-2018 2/2 named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Court of learned Sub- Divisional Judicial Magistrate, Samastipur in connection with Kalyanpur P.S. Case No. 28 of 2018, subject to the conditions as laid down under Section 438 Cr.P.C. As also subject to the conditions that one of the bailor should be family member of the petitioner.
