Petitioners seek bail in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code, Sections 37(B), 37(C) of the Bihar Prohibition and Excise Act, 2016 and Sections 25(1-b)a, 26, 35 of the Arms Act. From possession of the petitioners, firearm along with cartridges were recovered. Petitioner No. 1 has got criminal antecedent. Petitioners are in custody since 07.01.2019. Considering the nature of allegation, I am not inclined to enlarge the petitioners on bail for the present in connection with Sahebpur Kamal Police Station Case No. 11 of 2019 pending in the court of learned 2nd Additional Sessions

Patna High Court CR. MISC. No.23573 of 2019(4) dt.12-06-2019 2/2 Judge-cum-Special Judge, Excise Act, Begusarai. However, the petitioners may renew their prayer for bail, if the trial is not concluded within a period of six months from the date of receipt/production of a copy of this order.
