KUMAR ORAL ORDER 07-06-2017 Heard learned counsel for the petitioner and the State. Petitioner is apprehending his arrest in a. case for the offences registered under Sections 47A of the Bihar Excise Act, 1915.
Allegation is of recovery of 5.2 litres of foreign liquor from the hotel of the petitioner.
It has been contended on behalf of the petitioner that he has got no criminal antecedent. Petitioner is not the owner of the hotel. He has falsely been implicated in the present case due to political rivalry. No recovery was made either from his conscious possession or from his hotel.
Considering the facts and circumstances of the present case, let petitioner, above named, in the event of arrest or
Patna High Court Cr.Misc. No.22902 of 2017 (2) dt.07-06-2017 2/2 surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-cum-Sub Judge, 4th, Muzaffarpur, in Excise Case no. 11 of 2011, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
