====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 17-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Jhanjharpur P.S. Case No. 119 of 2018 instituted for the offence under Section 380 of Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. The name of petitioner has come in the confessional statement of co-accused Ranjeet Kumar recorded in Lakhnour (R.S.O.P.) P.S. Case No. 174 of 2018 in which it is mentioned that petitioner has purchased stolen Mobile from him. Thereafter, petitioner has been remanded in the instant case on 12.10.2018. There is no any seizure to substantiate that aforesaid Mobile phone was recovered from possession of the petitioner.

Patna High Court Cr.Misc. No.75014 of 2018(2) dt.17-12-2018 2/2 Petitioner is in custody since 12.10.2018.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jhanjharpur, Distt. Madhubani, in connection with Jhanjharpur P.S. Case No. 119 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
