JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-05-2017 This application has been filed for modification of the order dated 12.01.2017 passed in Cr. Misc. no. 54492 of 2016. Heard learned counsel for the petitioner.

It has been submitted on behalf of the petitioner that by order dated 12.01.2017 petitioner was granted anticipatory bail with a direction to surrender before the court below within a period of six weeks but petitioner failed to surrender within the aforesaid period and seeks modification of the order by extension of time to surrender.

Heard learned A.P.P. also.

Having heard both sides and in view of the fact that six weeks time has expired in the month of February, 2017 and petitioner has come after a period of about four months to seek modification of the order, I am not inclined to modify the order

However, let petitioner surrender in the court below at Motihari in connection with Kesariya P. S. Case no. 239 of 2016 and make prayer for regular bail which will be considered on its own merit without being prejudiced by the order of this Court. (Vinod Kumar Sinha, J) sudip/- U T
