This application has been filed on behalf of the petitioner for quashing the order dated 05.02.2019 passed by ACJM,III, Motihari, East Champaran in Trial No. 2861 of 2018 arising out of Motihari (Town) P.S. Case No. 11 of 2010. After some argument, learned counsel for the seeks permission to withdraw this application with a liberty to the petitioner to file an application for alteration of charge as he has submitted that no offence is made out under Section 138 of the N.I. Act.

Permission is granted with the aforesaid liberty.
