JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 18-05-2017 The petitioner seeks cancellation of grant of anticipatory bail in favour of Opposite parties No. 2 to 4, who were accused in Shastri Nagar P. S. Case No. 364 of 2016 for the offences punishable under Sections 341,323,504,379 read with Section 34 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the petitioner is tenant of Opposite parties No. 2 to 4. According to him, in course of investigation, the Opposite parties had agreed to return back to petitioner the articles worth Rs. 35,00000/- which were there in the rented premise and belonged to him. He has further submitted that the petitioner was residing in the rented

premise against in accordance with the terms of the rent agreement.

Apparently, the parties are litigating over some dispute, basically of civil nature. This application for cancellation of bail does not appear to be bona fide. No case for cancellation of bail is made out.

This application is, accordingly, rejected.
