2. The present petition has been preferred for the grant of following relief(s):

"(i) stay the operation and implementation of the alleged consolidation entry made in favour of the respondents No. 5 in Case No. 199/1985-86 under section 12(U) of the consolidation act as the same appears to be based on non-existent records as per the RTI reply dated 04.12.2023. (ii) direct the respondent No. 3 the consolidation officer not to grant any permission for sale, transfer or alienation of the land in question situated at village Kalyanur Thana No.

Patna High Court CWJC No.5796 of 2026(3) dt.13-07-2026 2/2 87, Khata No. 485, Chak Khesara No. 1222, 1719, 1118, 383, 408, 559, 380, 1495, 387, 420, 546, 751, 1342, 1173, Area, 6.19 Decimal, during pendency of the present writ petition.

(iii) further restrain respondents No. 5 creating any third party interest or executing any sale deed with respect to the lands in question during the pendency of this writ petition on as the lands in question are still undivided properties.

(iv) pass any other order/orders which this Hon'ble Court may deem fit and proper in the interest of justice."

3. After some argument, learned counsel for the petitioner prays for withdrawal of the petition to pursue the remedy before a competent Civil Court.

4. Learned State counsel has no objection.

5. Granting said liberty, the writ petition is disposed of.
