Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 47(a) and 53(a) of the Bihar Excise (Amendment) Act. Allegation against petitioner is that from his possession 300 ml. country made liquor has been recovered. It has been submitted on behalf of petitioner that he is in custody since 22.9.2016. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. It is alleged that 300 ml. country made liquor is said to have been recovered from the possession of petitioner. No compliance of Section 100 of the Code of Criminal Procedure is made.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

Patna High Court Cr.Misc. No.51979 of 2016 (2) dt.06-12-2016 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura, in connection with Case no. C-98(7) of 2016.
