JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-10-2016 The present application has been filed for cancellation of bail of opposite party who was granted bail vide order dated 14.12.2011 passed in Cr. Misc. No. 42547 of 2011 in connection with Musarigharari P.S. Case No. 112 of 2010 registered under Sections 147, 148, 149, 188, 353, 186, 283, 323, 427, 504 of the Indian Penal Code.
The prosecution case is that the opposite party and others surrounded the police jeep, blocked the National Highways-28 and and thereby caused inconvenience to the public. The accused persons also caused injuries to the public.
Considering the accusation being omnibus and general against the mob, four persons namely Santosh Kumar, Rahul Kumar Jha, Ranjan Kumar Jha and Krishna Mohan Jha were granted anticipatory bail. The State has preferred the present application for cancellation of bail only
Patna High Court Cr.Misc. No.41769 of 2012 (2) dt.05-10-2016 2/2 with regard to Santosh Kumar @ Santosh Kumar Jha on the ground that subsequent to the present case, he threatened the panchayat Mukhiya leading to registration of Dalsinghsarai P.S. Case No. 151 of 2012 under Sections 25(1-B)a/26/35 of the Arms Act.
Considering the fact that opposite party was granted bail on 14.12.2011 and since then only one case was registered in 2012. There is nothing on record to suggest the present stage of Dalsingsarai P.S. Case No. 151 of 2012 or the present case being Musarigharari P.S. Case No. 112 of 2010. There is nothing on record to suggest that since 2012 till date the opposite party has been made accused in any other case, this Court is not inclined to interfere.
The application stands dismissed in connection with Musarigharari P.S. Case No. 112 of 2010, pending in the Court of learned Chief Judicial Magistrate, Samastipur.
