The present application prays for grant of bail in connection with Deo P.S. case no. 88 of 2014, registered under Section 395 of the IPC.

A dacoity was committed in the house of the informant when the informant, his wife and daughter were captivated by the miscreant. The petitioner was arrested in connection with another case registered under Section 395 of the IPC and on his disclosure statement, he has been made accused in the present case.

It is submitted that the daughter of the informant has named the present petitioner in course of investigation. She has not earlier disclosed the name of the petitioner. The petitioner is

Patna High Court Cr.Misc. No.43756 of 2016 (5) dt.16-03-2017 2/2 languishing in jail custody since 19.01.2016. Learned counsel for the State, opposed the prayer and submits that there is material on record which indicate the complicity of the petitioner in the said crime. Considering the facts and circumstances of the case, this Court, for the present, is not inclined to extend him the privilege of bail. Prayer is, accordingly, rejected. The petitioner may renew his prayer for bail if all the prosecution witnesses are not produced at the trial within 09 months from the date of receipt/communication of a copy of this order.
