JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-02-2021 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Maner P.S. Case No. 655 of 2018 (S.Tr. No. 940 of 2019) for the offence under Section 302 of the Indian Penal Code. Allegation against this petitioner is that he was involved in assaulting and killing the husband of the informant and thereafter throwing the dead body at the bed of the brickkiln. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 25.06.2019. He further submits that there is no eye witness to the occurrence.

Considering the fact that there is no eye witness of the occurrence to support the allegation against this petitioner, the
