====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ----------------- 15-10-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Morkahi P.S. Case No.55 of 2015/G.R. No.1586 of 2015 registered under Sections 323, 420, 406, 467, 478 and 469 of the Indian Penal Code.

The prosecution case is that the lands of Khata No.6, Khesra No.463 and Khata No.207, Khesra No.105 of village-Dahma Mohanpur, P.S.

Alauli, District-Khagaria, belong to the complainant/informant. Accused no.1, Md. Sohail on hatching conspiracy accompanied Sanju Khatoon to the Registry Office and put her in place of Mulsan Ara, the sister of the informant, in the Registry Office and got executed the sale deed in respect of one Bigha Five

Patna High Court Cr.Misc. No.45632 of 2015 (2) dt.15-10-2015 2/2 Dhors land in favour of the accused no.4, Raj Kishore Singh on which this petitioner and accused no.3 put their signature as witness. Learned counsel appearing on behalf of the petitioner submits that Sanju Khatoon, who is said to be taken at the Registry Office by the accused no.1 and was put at the place of the sister of the informant to execute the sale deed in respect of the said land, has already filed Complaint Case No.1268C of 2014 in the court of the Chief Judicial Magistrate, Khagaria, in which this petitioner has not been made accused. In fact, Mulsan Ara, the sister of the informant, had come at the Registry Office for execution of the sale deed of the land for her share but the informant only to put pressure upon the petitioner and others has lodged this false case.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Khagaria, in connection with Morkahi P.S. Case No.55 of 2015/G.R. No.1586 of 2015, subject to the conditions laid down under Section 438(2) Cr.P.C.
