The petitioner seeks modification of the order dated 09.12.2019 passed by a Bench of this Court in Criminal Miscellaneous No. 73345 of 2019. By the aforesaid order, the petitioner was directed to be enlarged on bail in the event of his arrest or surrender before the Court below within a period of three weeks from the date of receipt of a copy of that order.

However for the reasons which have been explained in the petition, the petitioner could not surrender

Patna High Court CR. MISC. No.21790 of 2020(2) dt.07-07-2020 2/2 within the period mentioned in the order dated 09.12.2019. The order dated 09.12.2019 is modified to the extent that in case the petitioner surrenders before the court below within a period of six weeks from today, he shall be accorded the privilege under the order dated 09.12.2019 with the same terms and conditions.

The order stands modified to the extent indicated above.

The modification application stands disposed of accordingly.
