The petitioner seeks bail in connection with Mahila P.S. Case No. 53 of 2018 instituted for the offence under Section(s) 341/323/376/354/504/506/379 of the Indian Penal Code.
Learned counsel for petitioner has submitted that informant herself has stated in the written report that she was having love affair with this petitioner. Both used to have physical relationship when they got opportunity . The victim girl in her statement recorded U/s 164 Cr.P.C. has stated that she was having love affairs with this petitioner for about five years. The victim girl has been medically examined. The
Patna High Court Cr.Misc. No.74606 of 2018(2) dt.13-12-2018 2/2 doctor has found no injury of recent sexual conduct. No any fresh injury over private part.
Learned counsel submits that this case has been lodged by the informant since the petitioner has stopped sending money to her from Dubai.
Petitioner is in custody since 10.8.2018.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Siwan in connection with Mahila P.S. Case No. 53 of 2018, subject to the condition that both the bailers shall be the close relative of the petitioner.
