JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Section 420 of the Indian Penal Code.

It is alleged that the complainant advanced Rs.50000/- for supply of bricks to the petitioner but neither the bricks were supplied nor money was returned.

It is submitted by learned counsel for the petitioner that the petitioner worked as labourer for constructing the house of the complainant and for non-payment of wages Complaint Case No. 1764 of 2012 was filed on 17.10.2012 and as a retaliatory measure

Patna High Court Cr.Misc. No.2787 of 2015 (2) dt.21-01-2015 2/2 the present complaint has been lodged.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., West, Muzaffarpur in connection with Complaint Case No. 1950 of 2012 subject to the conditions as laid down under Section 438(2) Cr.P.C.
