Petitioner is apprehending his arrest in a case registered for offences punishable under Sections 341, 323, 324, 307, 354, 504/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that though there is allegation that the petitioner assaulted one Jiaul Haque by means of Farsa but the injury was not on the vital party of the body and there is no repetition of blow. Learned counsel for the petitioner further submitted that there is case and counter case between the parties.

Heard learned A.P.P. also.

Considering the submission, as above, this application is

Patna High Court Cr.Misc. No.48774 of 2016 (3) dt.11-01-2017 2/2 allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within a period six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jhanjharpur, Madhubani in connection with Madhepur P.S. Case No. 27 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
