JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 08-04-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Complaint Case No. 145 of 2011 for the offenses under Section 498A of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner was earlier granted bail on the condition that he will pay Rs. 750/- per month to the opposite party No. 2 fixed by the court but he failed to pay the same and as a result thereof his bail bond has been cancelled. Learned counsel further submits that the petitioner is ready to keep his wife and he has tried his best to pay the arrears as well as current amount of Rs. 750/- per month but the opposite party no. 2 has joined the wedlock with

In the totality of the fact situation, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Kaimur (Bhabua) in connection with Complaint Case No. 145 of 2011, subject to the condition that in the event the opposite party no. 2 appears in the proceeding before the Court below, the Court below shall refer the matter to the Mediation Center and if there is response from the complainant, the court below will take appropriate final decision at the earliest preferably within a period of four months.
