22-12-2016 Heard Sri Aditya Nath Jha, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner has prayed for grant of bail in Bagaha (Pathkauli) P.S. Case No. 361 of 2016 registered for offence under Section 20(b), 22(a) of the Narcotic Drugs & Psychotropic Substances Act, 1985.
By way of referring to F.I.R., it was submitted by learned counsel for the petitioner that petitioner has been apprehended on an allegation of recovery of Ganja weighing about 100 gm. By way of referring to statement made in paragraph - 3 of the petition, it has been argued that petitioner is having clean antecedent and he has falsely been implicated.
Patna High Court Cr.Misc. No.49555 of 2016 (2) dt.22-12-2016 2/2 Considering the recovered weight of Ganja i.e. 100 gm much lesser than the smaller quantity, clean antecedent of the petitioner and period of custody, let the petitioner namely Shyam Bihari Chaudhary be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd A.D.J., Bettiah, West Champaran in connection with Bagaha (Pathkauli) P.S. Case No. 361 of 2016.
