JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code and Section 27 of the Arms Act. Petitioner is said to have opened fire causing firearm injury to informant. The informant was examined by the doctor after the alleged occurrence and numerous pellets embedded with left arm elbow and left scapular region of informant were found. However, the doctor opined that aforesaid injuries were simple in nature. There is case and counter case between the parties and admittedly, the alleged occurrence took place on account of land dispute. Petitioner does not have any criminal antecedent and is languishing in jail custody since 23.07.2016.
