KUMAR ORAL ORDER 01-06-2017 Heard learned counsel for the petitioner and the State. Petitioner is apprehending his arrest in Kahalgaon P.S. Case no. 45 of 2017 for the offences registered under Sections 341, 323 and 498A of the Indian Penal Code and Sections 3 / 4 of the Dowry Prohibition Act.
It is alleged that petitioner including other in-laws of the family demanded Rs. 5 lacs and a motorcycle as dowry and due to non-fulfilment of the same, she was tortured and ousted from the matrimonial house.
It has been contended on behalf of the petitioner that petitioner has got no criminal antecedent. He is father-in-law of the informant. He is an old and retired person. The real fact is that earlier son of the petitioner was kidnapped from the side of
Patna High Court Cr.Misc. No.22630 of 2017 (3) dt.01-06-2017 2/2 the informant and he was forcibly solemnized with the informant. The husband of the informant has been granted bail by a Bench of this Court in Cr. Misc. no. 21965 of 2017.
Considering the facts and circumstances of the present case, let petitioner, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhagalpur, in Kahalgaon P.S. Case no. 45 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
