The petitioner seeks bail in Charpokhari P.S. Case No. 260 of 2017 instituted for the offence under Sections 363, 366 and 34 of the Indian Penal Code.
In the written report it is alleged that petitioner along with other accused persons has kidnapped the minor daughter of the informant.
Copy of case diary has been produced by the informant. It is mentioned in paragraph-20 of the case diary that victim girl has refused to get herself medically examined. The statement of victim girl recorded under Section 164 Cr. P.C. has been enclosed as Annexure-2 wherein she has
Patna High Court Cr.Misc. No.74471 of 2018(3) dt.17-12-2018 2/2 stated that petitioner is her friend. She had gone to her Mama house after becoming angry with her mother. She had not gone with this petitioner.
Counsel for the informant has appeared and opposed the prayer for bail. He has submitted that victim girl is minor. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-X, Bhojpur, Ara, in connection with Charpokhari P.S.
