The petitioners apprehend their arrest in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code. As per the prosecution case, in order to release the arrested accused Lalit Ranjan Singh @ Lali who was wanted in connection with Akbarpur PS Case No. 179 of 2021, all the FIR named accused persons and 30-40 unknown obstructed the police office officials in discharging their duty, damaged the

Patna High Court CR. MISC. No.22743 of 2022(2) dt.06-09-2022 2/2 vehicle, abused and tried to snatch the arms of police personnel and also got the arrested accused released from the police custody.

It is submitted that there is general and omnibus allegation and no specific overt act has been alleged against petitioners. Petitioners have been made accused in this case on the identification of Chowkidar. Petitioners have been made accused in this case only on suspicion. Petitioners claim clean antecedent.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate X, Gaya in connection with Fatehpur P.S. Case No. 123 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
