JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 2 26-08-2020 Heard learned counsel appearing on behalf of the petitioners and learned counsel appearing on behalf of the State. The petitioners are in custody in connection with C2120 of 2020 for offences under Sections 30(A) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel appearing on behalf of the petitioners would submit that the petitioners have no criminal antecedents and they are driver and Khalasi of pickup van which was carrying 3480 litres of country made liquor from which aforesaid liquor was seized. The petitioners are in custody since 12.02.2020. Considering the fact that the petitioners have no criminal antecedents and they have remained in custody for more than six months, the Court is inclined to grant bail to them. The petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five

thousand) with two sureties of the like amount each to the satisfaction of Additional District Judge II-cum-Special Judge, Excise Act, Sitamarhi in connection with C2-120 of 2020. Further on release the petitioners shall render their services as volunteers to combat the Covid pandemic for a period of one month. They are required to report before the Civil Surgeon, Sitamarhi-cum-Nodal Officer, Covid. (Anil Kumar Upadhyay, J) BT/- U T
