2. The petitioners are apprehending arrest in connection with Jehanabad P.S. Case No. 1220 of 2023 lodged on 27.12.2023 for offences punishable under Section 147, 149, 341, 323, 325, 307, 452, 337, 504 of the Indian Penal Code.
3. As per the prosecution story F.I.R. has been lodged against 13 named accused persons with an allegation that they have abused the informant and assaulted her from Lathi.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.25044 of 2024(2) dt.01-05-2024 2/3 petitioners are innocent and has committed no offence. He further submits that petitioner have clean antecedents. He submits that for the same place and date of occurrence, case and counter case has been lodged by all the brothers. He submits that the informant and the petitioner of the present case have common ancestors. Counsel further submits that from the content of F.I.R., it transpires that the dispute has arisen due to the family members. None of the parties are criminals but at the spur of anger, scuffling took place and both the parties got injured. Informant side has filed Jehanaband Nagar P.S. Case No. 1220 of 2023 whereas the petitioner side has filed Jehanabad P.S. Case No. 1221 of 2023. Counsel submits that petitioners are law abiding citizen and are ready to fulfill all the conditions whatsoever shall be imposed.
5. Learned APP for the State opposes the prayer for bail.
6. As such, considering the aforesaid facts and circumstances, let the above named petitioner be released on bail, in the event of arrest of surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs. 30,000/- (Thirty Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief
