Heard learned counsel appearing on behalf of petitioner and learned A.P.P. for the State.

This application is filed for Modification of order dated 19.11.2019 passed in Criminal Miscellaneous No. 73011 of 2019.

Learned counsel appearing on behalf of the petitioner submits that vide order dated 19.11.2019 passed in Criminal Miscellaneous No. 73011 of 2019, the petitioner was directed to be released on bail in the event of his arrest or surrender before

No.7835 of 2021(2) dt.24-02-2021 2/2 the court below within the period of six weeks on furnishing the bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of the leanred A.C.J.M-1, Danapur, Patna, in connection with Danapur P.S. Case No. 193 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C., but due to some unavoidable circumstances, petitioner could not surrender before the court below within the stipulated period.

In such view of the matter, the time to surrender of petitioner, as per order dated 19.11.2019 passed in Criminal Miscellaneous No. 73011 of 2019, is further extended by six weeks from today in connection with aforesaid case. Accordingly, the modification application is allowed and the order dated 19.11.2019 passed in Criminal Miscellaneous No. 73011 of 2019 is modified to the above extent.
