The petitioners apprehend their arrest in Dehri (Town) P.S. case No. 206 of 2016 under Section 363, 366(A), 34 of the Indian Penal Code.
The informant alleged that his daughter was going to attend the course of beautician but the petitioners and Vicky Kumar kidnapped his daughter.
The learned counsel for the petitioners submits that informant is not an eye witness of the occurrence. Vicky Kumar is said to have enticed the daughter of informant. The petitioners are uncles, mother, sister and brother of Vicky Kumar and that is why
Patna High Court Cr.Misc. No.46260 of 2016 (3) dt.15-12-2016 2/2 they have falsely been implicated in the case. Considering the fact that petitioners are uncles, mother, sister and brother of Vicky Kumar, who is said to have fled away with the daughter of informant, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Dehri, Rohtas at Sasaram in Dehri (Town) P.S. Case No. 206 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
