JUSTICE RAKESH KUMAR ORAL ORDER 01-07-2017 Heard Sri N.K. Agrawal, learned senior counsel, assisted by learned counsel for the petitioners and learned Additional Public Prosecutor.

Two petitioners apprehending their arrest in Complaint Case C-1 -286 of 2016 registered for the offence under section 406, 420, 323, 379, 504, 341 / 34 of the Indian Penal Code, have prayed for grant of bail in the event of their arrest or surrender. Learned senior counsel has drawn my attention to the statement of the complainant recorded on S.A. and submits that on the basis of his statement on oath it is evident that in a business dispute colour of criminal offence has been given.

Patna High Court Cr.Misc. No.21864 of 2017 (2) dt.01-07-2017 2/2 Learned Additional Public Prosecutor has opposed the prayer for bail , however after considering the nature of accusation, the court is of the opinion that it is a fit case for extending the privilege of anticipatory bail. Accordingly, in the event of arrest or surrender within a period of six weeks from today, let both the petitioner Md. Vasim @ Md. Vasim Akram @ Chunnu @ Vasim Akram and Nasim @ Md. Nasim Akram be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar / concerned court in connection with C-1-286 of 2016 subject to the conditions as contemplated under section 438(2) of the Code of Criminal Procedure 1973.
